Information Regarding Attorney's Fees In Workers' Compensation Cases:
- No fees are required to attain a Workers' Compensation attorney. In fact, the injured worker typically never pays the attorney directly. By law, all fees or fee agreements must be approved by a judge from the Worker's Compensation Appeals Board. Fees are almost always paid out of permanent disability benefits and are awarded when the case is concluded and the permanent disability of the injured worker is established.
- The amount of the fee is normally 9% to 12% of the permanent disability awarded. In determining the fee the Workers' Compensation Appeals Board considers the following factors:
- the responsibility assumed by the attorney;
- the care exercised in representing the injured worker;
- the actual time involved;
- the results obtained.
In addition to permanent disability, occasionally fees can be awarded in disputed issues involving other benefits such as temporary disability. Also, there may be a fee allowed for services in representing injured workers before the Rehabilitation Unit of the Workers' Compensation Appeals Board. As above, these fees must be approved and are taken as a percentage of the benefits actually received.
